1. LIMITATION OF LIABILITY
Dawson Manufacturing’s total liability for any claim related to the purchase, use, installation, or operation of any product is strictly limited to the amount paid by the customer for the product.
Under no circumstances shall Dawson Manufacturing be liable for:
- Lost profits
- Business interruption
- Loss of revenue
- Downtime
- Labor costs
- Secondary or consequential damages
Dawson Manufacturing is not responsible for:
- Improper installation performed by the customer or third parties
- Misuse, abuse, or operation outside intended use
- Operator error or accidents
- Failure to follow training, safety procedures, or maintenance guidelines
Once any product leaves Dawson Manufacturing’s facility:
- Dawson Manufacturing has no control over shipping
- Is not liable for delays, damages, or loss in transit
- All claims must be made directly with the freight carrier
2. WARRANTY TERMS & CONDITIONS
General Warranty Structure
- Warranty applies ONLY to the original purchaser
- Warranty is NON-TRANSFERABLE
- Warranty is VOID unless ALL required training and documentation are completed and submitted
Warranty Activation Requirements
To activate warranty:
- Customer must complete all required training programs
- Customer must submit installation checklist + required photos
- Dawson Manufacturing must review and approve installation
If this process is not completed:
👉 Warranty is VOID
What is NOT Covered (Critical Section)
The following are NOT covered under warranty:
- Conveyor belts / hybrid belts
- Tires
- Bearings
- Any rubber components
- Wear items / consumables
Misuse & Ripple Effect Clause
If a customer:
- Operates equipment incorrectly
- Fails to follow training
- Fails to maintain equipment
- Fails to properly charge electrical systems
Then:
- The original failure is NOT covered
- ANY resulting damage (ripple effect) is ALSO NOT covered
Example - Failure to charge machine → voltage drop → amp increase = heat → electrical damage occurs.
👉 NONE of that is covered
Additional Warranty Limitations
- No warranty on used, demo, or refurbished equipment
- No warranty on third-party products
- No guarantee of compatibility with customer-provided equipment
3. DEPOSITS, CUSTOM ORDERS & CANCELLATIONS
Deposits
- Deposits are 100% NON-REFUNDABLE
- Deposit = commitment to purchase
Custom Orders (Critical Protection Section)
Applies to:
- DMT / HDT Trailers
- Truck Bodies
- Hook Lifts
- Switch-N-Go Cans (SMC / RMC / HMC)
- Roll-Off Systems
- Any custom-built product
Payment Structure
- Minimum deposit:
- $1,500 (MulchMate example)
- 30% full trailer, body or can builds
Customer Commitment Clause
Once:
- Deposit is paid
- Specs are approved
- Order is placed
👉 Customer is FULLY OBLIGATED to complete purchase
There is:
❌ NO cancellation right
❌ NO reversal based on customer circumstances
Cancellation Penalty (Your “Teeth”)
If customer cancels AFTER production begins:
- Deposit is forfeited
- PLUS customer owes an additional 25% of total order value
This applies to ALL custom builds listed above as well as Mulch Mate's® and Truck Mate's®
30-Day Completion Rule
- Customer must finalize purchase within 30 days
- If not:
- ALL discounts are forfeited
- Order reverts to current standard pricing
12-Month Deposit Expiration
- Deposit remains valid for 12 months
- After 12 months:
👉 Deposit is forfeited completely
4. RETURNS & REFUND POLICY

RETURNABLE PRODUCTS (SMALL EQUIPMENT ONLY)
Includes:
- Kart Mate® (RS / PRO)
- Snow Mate® 36"+

Return Conditions
- Must notify Dawson MFG within 24 hours of issue and needs be returned within 7 days of delivery
- Must be:
- UNUSED
- UNDAMAGED
- IN ORIGINAL PACKAGING
- WITH ALL PARTS INCLUDED
- All return expenses will be customers responsibility
Restocking Fees
- Standard return: 25% fee
- Unopened / original sealed return: 10% fee
Damaged Returns
- If product is returned damaged:
👉 Only 50% refund issued
Shipping Responsibility
- Customer pays 100% of return shipping
- If Dawson assists:
👉 Additional 10% service fee
Refund Processing
- Inspection: 5–7 business days
- Credit card refunds: +2–10 days
- Check refunds: 7–10 processing + shipping time
International Orders
❌ NO RETURNS
❌ ALL SALES FINAL
Third-Party Purchases
- Must go through original seller
- Dawson Manufacturing will NOT accept returns
5. CUSTOMER CONDUCT & BLACKLISTING
Dawson Manufacturing reserves the right to:
- Refuse service
- Cancel support
- Blacklist customers
For:
- Threats
- Harassment
- Abusive behavior
- Disrespect toward staff
Equipment Misuse Clause (Your Addition)
Blacklisting ALSO applies to:
- Abuse of equipment
- Using equipment outside intended purpose
- Ignoring training / safety procedures
6. FORCE MAJEURE (DELAYS OUTSIDE CONTROL)
Dawson Manufacturing is NOT liable for delays caused by:
- Severe weather (snowstorms, hurricanes, etc.)
- Power outages
- Local or Transit disruptions (even if customer is unaffected)
- Cyberattacks / System failures
- Supply chain disruptions
- Government actions
- Global shut downs
7. NO BUYBACK POLICY
- Dawson Manufacturing does NOT offer buybacks
- No obligation to repurchase equipment
If assistance is ever provided:

👉 Not a public or guaranteed program
8. SHIPPING, LTL, & CUSTOMER-ARRANGED SHIPPING
Standard Shipping
- Dawson controls shipping by default
- Products ship to nearest freight dock
LTL Pickup Responsibility
If customer fails to pick up shipment:
👉 Customer pays ALL:
- Storage fees
- Holding fees
- Redelivery fees
Customer-Arranged Shipping
- NOT allowed by default
- If approved:
- Customer pays service/handling fee a minimum of $300.00 USD
9. FINANCIAL RESPONSIBILITY (EXPANDED — WHAT YOU WANTED)
If equipment is:
- Financed
- Leased
- Under lien
Customer MUST:
- Maintain equipment in proper working order
- Follow all maintenance + training requirements
Failure to maintain equipment:
👉 May violate financing agreement
👉 May void warranty
👉 May result in loss of support
10. PRODUCTION DELAYS & MANUFACTURING CORRECTIONS
Dawson Manufacturing reserves the right to:
- Pause production at any time
- Correct defects or safety issues
- Improve product quality
This may:
- Delay production
- Delay delivery timelines
👉 Dawson is NOT liable for these delays
11. WARRANTY TRANSFER RESTRICTION
- Warranty applies ONLY to original purchaser
- If product is sold:
👉 Warranty is cancelled immediately
